When a Georgia DUI Becomes a Felony
Georgia law draws a clear line between misdemeanor and felony DUI. Two separate circumstances cross that line. The first is a fourth DUI conviction within a 10-year lookback window. Georgia measures that window from the arrest date of each prior conviction to the arrest date of the current charge, not from conviction to conviction. Under this framework, a first, second, and third DUI within 10 years remain misdemeanors (the third as a high and aggravated misdemeanor), but the fourth triggers a felony.
The second path to a felony DUI has nothing to do with prior convictions. Any DUI arrest involving a death or serious bodily injury to another person is charged as a felony regardless of your driving record. There’s also a related charge worth knowing: driving while your license is revoked under habitual violator status is itself a separate felony.
Felony DUI Penalties in Georgia
The statutory penalties for a felony DUI conviction are substantially more severe than anything attached to a misdemeanor charge. The full scope matters when you’re weighing your options.
- Prison: One to five years, with a mandatory minimum of 90 days actually served in custody even if the remainder is suspended or probated
- Fines: $1,000 to $5,000, plus court costs and surcharges
- Community Service: At least 60 days required
- Programs: Completion of a DUI Alcohol or Drug Use Risk Reduction Program and a clinical evaluation
- Probation: Up to five years
- License Revocation: Habitual violator status, which revokes driving privileges for five years
Driving during that five-year revocation period carries its own felony charge: one to five years in prison and a fine of at least $750. The penalties compound quickly, which is why the decisions made in the early stages of a felony DUI case carry so much weight.
