What Georgia Law Says About Aggravated Assault
Georgia defines aggravated assault under O.C.G.A. § 16-5-21. A person commits this offense when they assault with intent to murder, rape, or rob; assault using a deadly weapon or any object likely to cause serious bodily injury or strangulation; or discharge a firearm from a motor vehicle toward another person. The statute covers a wide range of conduct, and what counts as a “deadly weapon” is broader than most people expect.
Firearms and knives clearly qualify, but so can blunt objects, vehicles, or everyday items like bottles when used offensively. Because the classification depends heavily on how an object was used rather than what it is, the prosecution has significant discretion in framing charges. That’s precisely why the defense theory needs to be developed early.
Sentencing Ranges & Mandatory Minimums in Georgia
The baseline sentencing range for aggravated assault is one to 20 years in prison. Several circumstances trigger mandatory minimums that raise the floor significantly:
- Assault on a peace officer performing official duties: not less than five nor more than 20 years
- Assault on an officer of the court during official duties: not less than five nor more than 20 years
- Victim age 65 or older: not less than three nor more than 20 years
- Family violence enhancement (current or former spouses, co-parents of the same child, parents and children, stepparents and stepchildren, foster parents and foster children, or other household members): not less than three nor more than 20 years
A family violence enhancement can arise from a dispute between people who no longer live together. If the alleged victim falls into any of these categories, the sentencing exposure shifts immediately, and that has direct implications for how the defense is built.
Bibb County Superior Court & the Bond Process
Felony charges in Georgia, including aggravated assault, fall under the exclusive original jurisdiction of Superior Court. In Bibb County, that means Bibb County Superior Court, which sits within the Macon Judicial Circuit alongside Crawford and Peach Counties.
Bond isn’t always set at the magistrate level. If you were on probation, parole, or bail at the time of the alleged offense, or if you have a prior conviction for aggravated assault, kidnapping, arson, burglary, or certain other listed offenses, Georgia law requires that bond be set by a Superior Court judge rather than at first appearance.
